Terms of Service

Please read these Terms of Service (“Terms”, “Agreement”) carefully before using the reclaim-control.com website and the consulting services (the “Service”) operated by RC Executive Systems (“we”, “us”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, clients, and others who access or use the Service.

1. Description of Services

RC Executive Systems provides high-level executive consulting, system architecture design, and software integration services. This includes, but is not limited to:

• The Productivity Tax Audit and subsequent Executive System Blueprints.
• The 90-Day Executive System Installation Program.
• The ongoing “Executive Concierge” managed continuity subscription.

2. Payments, Deposits, and Non-Refundability

By purchasing our consulting services, you agree to the following financial terms:

• Phase 1 Deposit: A deposit is required to secure your System Integrity Review and initiate the 90-day installation process.
• Software Licensing: During the initial 90-day installation, RC Executive Systems may cover or manage the licensing costs of approved Tier 1 AI software integrations as a complimentary concierge service.
• Continuity Subscription: Following the 90-day installation, clients may be transitioned to the “Executive Concierge” managed service to maintain system integrity, software licensing, and ongoing support.
• Non-Refundable Fees: All Fees are non-refundable once paid to RC Executive Systems. We do not provide prorated refunds for partial month usage or incomplete program execution.
• Cancellations: You may cancel the continuity subscription at any time with 30 days written notice. Upon cancellation, all third-party software licensing managed by us will be deactivated.

3. Disclaimer of Results & Success

RC Executive Systems does not promise, guarantee, represent, or warrant any specific level of success, financial income, sales, or specific results from the use of our Site, Content, or consulting Offerings.

Individual results will vary from user to user. You acknowledge that monetary, time-saving, and operational results are based on many factors. You agree that your success, however defined by you, is your own responsibility, and RC Executive Systems assumes no responsibility, fiduciary or otherwise, for your success or lack thereof. Your business’s results will vary depending on a variety of factors unique to your business, your personal effort, your team, and your operational adherence to the installed systems.

4. No Professional, Medical, or Legal Advice

NEITHER RC EXECUTIVE SYSTEMS NOR THE SITE PROVIDES MEDICAL, THERAPEUTIC, INVESTMENT, LEGAL, OR OTHER PROFESSIONAL ADVICE AND IS NOT INTENDED TO BE A SUBSTITUTE FOR SUCH ADVICE.

All content made available to you is for educational, operational, and informational purposes only. We are an operational consultancy, not licensed medical professionals or therapists. Any reference to mitigating “burnout,” “exhaustion,” or “fatigue” refers exclusively to operational and workflow management. Our advice and systems are not intended to diagnose, treat, or cure clinical burnout, psychological disorders, or any medical condition. You should always seek the advice of a licensed professional with any questions you may have regarding your individual health or financial situation.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of RC Executive Systems and its licensors. This includes all proprietary frameworks, custom Notion templates, diagnostic scorecards, workflows, and vendor Rolodexes provided during your installation. These materials are provided for your personal, individual use only and may not be reproduced, duplicated, copied, sold, resold, distributed, or exploited for any commercial purpose without express written consent.

6. Limitation of Liability

Under no circumstances will RC Executive Systems, its owners, directors, employees, contractors, or affiliates be liable to you, or any third party claiming through you, for any indirect, special, consequential, incidental, exemplary, or punitive damages (including, without limitation, loss of data, loss of income, loss of profits, or business interruption), whether the claim is based on contract, tort (including negligence), strict liability or any other legal theory.

THE TOTAL AGGREGATE LIABILITY OF RC EXECUTIVE SYSTEMS TO YOU OR ANY PERSON OR ENTITY CLAIMING THROUGH YOU WITH RESPECT TO THIS AGREEMENT, THE SITE, OR THE OFFERINGS WILL NOT EXCEED DIRECT DAMAGES IN THE GREATER OF (1) ONE HUNDRED UNITED STATES DOLLARS ($100.00), OR (2) THE AMOUNTS (IF ANY) YOU PAID TO RC EXECUTIVE SYSTEMS FOR ACCESS TO THE CONSULTING SERVICES IN THE ONE MONTH PRECEDING SUCH CLAIM.

7. Dispute Resolution & Arbitration

The parties will attempt to resolve all disputes arising out of or relating to this Agreement through negotiation within 15 days of notice. If any Dispute cannot be resolved through negotiations, the Dispute will be finally settled through binding arbitration under the arbitration rules of Judicial Arbitration and Mediation Services (“JAMS”).

The arbitration will be conducted exclusively in the English language before a sole neutral arbitrator in Los Angeles, California. The award of the arbitrator will be the exclusive remedy of the parties. Judgment upon the award may be entered in any court or governmental body having jurisdiction thereof.

8. Waivers of Collective Action and Jury Trial

YOU AGREE THAT YOU WILL PURSUE ANY CLAIM OR LAWSUIT RELATED TO ANY DISPUTE OR OTHERWISE ARISING FROM THIS AGREEMENT AS AN INDIVIDUAL, AND WILL NOT LEAD, JOIN, OR SERVE AS A REPRESENTATIVE OR USER OF A CLASS OR GROUP OF PERSONS BRINGING SUCH A CLAIM OR LAWSUIT.

THE PARTIES DESIRE TO AVOID THE TIME AND EXPENSE RELATING TO A JURY TRIAL. ACCORDINGLY, THE PARTIES HEREBY WAIVE TRIAL BY JURY OF ANY DISPUTE. THIS WAIVER IS KNOWINGLY, FREELY, AND VOLUNTARILY GIVEN.
